Conference on AGG Reform: Discrimination by AI
Germany Forward: That was the motto of the specialist conference organized by the Federal Anti-Discrimination Agency (ADS)
, held in Berlin on April 20th. The focus was on the reform of the General Equal Treatment Act (AGG). In this context, I had the honor of moderating one of four workshops. The topic: "Computer says no – Discrimination by Artificial Intelligence."
In the workshop, I discussed with experts & participants where the AGG, in its current form, has gaps in protection. Practical research and legal aspects were the main focus, and concrete proposals were put forward. The conclusion:
The reform of the AGG is a good opportunity to close these protection gaps. Additional remark:
In July 2023, the ADS proposed a total of 19 measures in its basic paper for the reform of the AGG. Protection against discrimination by artificial intelligence was also included: Action by automated decision-making systems (ADM) should be included as a discriminatory act in § 3 AGG.
